PEOPLE OFTEN BRING WATER, TOWEL, AND SUNSCREEN.
2- WHEN YOU BOOK AND PAY ONLINE, YOUR RESERVATION IS 100% GUARANTEED. WE WILL ANSWER YOUR RESERVATION REQUEST WITHIN 12 HOURS.
2a- GIFT CERTIFICATES MUST CALL IN TO BOOK LESSON.
3- IF YOU MAKE A RESERVATION ONLINE AND DO NOT PAY, YOUR LESSON IS NOT BOOKED. WE ARE SORRY, BUT THIS POLICY WAS INSTILLED DUE TO ALL THE FLAKY "A" HOLES WHO WASTE OUR TIME. WE RESPECT YOUR TIME AND WE ALWAYS SHOW UP EARLY FOR YOUR LESSON.

IF WE CAN NOT GIVE YOU THE INSTRUCTOR YOU WANT, YOU NEED TO CANCEL WITH IN 24 HOURS, IF WE CHANGE INSTRUCTOR FOR YOU WITH LESS THAN 24 HOUR NOTICE AND YOU DO NOT WANT TO DO THE LESSON, YOU WILL BE CHARGED IN FULL FOR YOUR LESSON. WE FACTOR IN ALL VARIABLES WHEN PLANNING OUR LESSONS AND TIDE AND SWELL SIZE ARE MAJOR COMPONENTS WHEN WE ACCEPT OR SUGGEST ALTERNATE TIMES, ESPECIALLY FOR LESSONS NEEDING A HIGHER LEVEL OF CARE.

14- WHILE DOING A LESSON WITH KAPOWUI OR AT ANY TIME YOU ARE IN THE AREA OF OUR BUSINESS OPERATION, YOU GIVE UP YOUR RIGHTS TO ANY LEGAL RECOURSE OR MONETARY COMPENSATION AGAINST KAPOWUI, ANY OF IT'S INSTRUCTORS, OR THE CITY OF LOS ANGELES DUE TO INJURY OR DEATH SUFFERED WHILE IN OUR CARE OF OR BY ANY OF OUR EQUIPMENT, VANS, ACTS OF GOD, OR INSTRUCTORS. WE HAVE NO MONEY ANYWAY BUT LEGAL MUMBO JUMBO THAT MUST BE POSTED.

Liability Waiver
KAPOWUI - RELEASE OF LIABILITY, WAIVER, AND ASSUMPTION OF RISK AGREEMENT, CAUTION: DO NOT SIGN THIS DOCUMENT WITHOUT READING IT IN ITS ENTIRETY AND CAREFULLY. BY SIGNING THIS
DOCUMENT, YOU GIVE UP IMPORTANT LEGAL RIGHTS! SURFING IS AN ATHLETIC ACTIVITY, THE PARTICIPATION IN WHICH
INVOLVES VARIOUS RISKS. PLEASE READ AND UNDERSTAND THIS DOCUMENT.
THIS IS A LEGAL DOCUMENT. MY SIGNATURE IS MY ACKNOWLEDGMENT OF THE CONTENTS OF THIS CONTRACT. I WILL NOT SIGN THIS DOCUMENT UNLESS I FULLY UNDERSTAND AND AGREE TO BE BOUND BY ITS CONTENTS. You can consult an attorney before signing.
I, ___________________________________, being an adult, (or a minor on whose behalf a parent or legal guardian is signing this document) (hereafter “I” or “me”), acknowledge that:
1) I Know How To Swim And To Maintain Buoyancy In Open Water, And I Am In Good Health: My swimming skills are above those of a novice and I can maintain my head above water when my feet do not make contact with the bottom for extended periods of time. Likewise, I am in good physical and mental health, I am not under the influence of any drugs, alcohol, or other substances which may impair my swimming skills or my ability to take and follow instructions. I am not pregnant nor am I suffering from any spinal or skeletal defect, hearing, vision or balance impairment or other physical impairment. I understand that the foregoing representations as to my physical condition are being relied upon by KAPOWUI. I hereby agree to follow all rules, regulations, and instructions of KAPOWUI while participating in this class, lesson, or while renting equipment from KAPOWUI.
2) I Acknowledge That Surf May Be Dangerous And I Accept And Assume Such Risk: I am aware that open water activities in general, and in surf specifically, involves inherent risks. I may damage my belongings, get hurt, get injured, become ill, drown, or even die. I further acknowledge that I have voluntarily chosen to rent equipment or take surfing lessons from KAPOWUI, or if the individual taking such lessons or renting equipment is a minor, I have, as the minors parent or legal guardian, voluntarily consented to such minor taking of such lessons, or renting equipment. I know and fully understand that water sports in and around surf are dangerous outdoor activities in an uncontrolled natural environment with inherent risks and hazards, where serious accidents can occur, participants can sustain property damage, injuries, illness and even die. I acknowledge and willingly and voluntarily assume all risks and hazards in surf and beach related activities in all phases of these activities from the training sessions until the conclusion of the class, lesson, or equipment rental period, including, but not limited to those involving, (1) loss of control of the surfboard or other equipment, malfunction of the surfboard or other equipment, falls from the surfboard or other equipment, collision with other participants, equipment, other surfboards, rocks, and any other man made or natural obstacles, whether obvious or not; (2) judgment, decision making and conduct of the instructors; (3) submersion in water, drowning; (4) encounters with animals, marine life, plant life, rocks and insects; (5) exposure to outdoor ocean environment, bacteria or microbes, extreme temperatures, sun, and inclement weather, including travel by foot or vehicle in any way related to this activity; (6) assistance in lifting and/or carrying surfing equipment; (7) rescue-related injuries; and (8) unavailability of immediate and appropriate medical attention in case of injury. I understand and acknowledge that the above list is not meant to be complete or exhaustive; that other unforeseen and unanticipated risks, known or unknown, may also exist and result in damage, injury, illness, disease, or death.
3) I Waive My Right To Sue KAPOWUI: In consideration for KAPOWUI agreeing to provide me with equipment rental or surfing instructions and/or allowing me to participate in this class or lesson, I agree that I shall not make a claim or bring any action against, sue, or hold responsible, the City of LOS ANGELES, its employees and other agents, KAPOWUI, its owners (including MARTIN SQUIRES), officers, agents, employees, associates, representatives, (referred to collectively in this agreement as KAPOWUI or expect, require, or pursue them, to be held accountable for any damages. I voluntarily agree to release, discharge, and hold harmless KAPOWUI from and against any and all claims of liability, even those arising out of their negligence, fault, recklessness, or any other act or omission which causes me damages, property damage, illness, personal injury, disease, or death, of any nature in any way connected with my participation in this activity or any bodily injury sustained in or around kapowui’s area of operation including any and all of kapowui’s property. I also expressly agree to release and discharge KAPOWUI from any act or omission, not excluding acts of wanton or gross negligence, in rendering or failing to render any type of rescue, emergency or medical services.
4) Indemnity: I further agree, to hold harmless, defend, and indemnify KAPOWUI and the City of LOS ANGELES from all defense costs, including attorneys fees incurred in connection with any claims arising from the activities anticipated herein, including but not limited to those for bodily injury, wrongful death, or property damage, whether caused by or sustained by any minor under 18 years of age on whose behalf I am signing, or which I may have caused to or by spectators or other third parties, whether negligent or not, in the course of my participation in this activity or at anytime while in the care of or around kapowui’s area of operation by any person, equipment or kapowui’s assets. In the event of any actions, regardless of where venue lies, any such actions shall be filed in the State Court of Los Angeles County, California. In the event that any action is filed other than in the State Court of Los Angeles County, California, it shall be moved to State Court of Los Angeles County, California on motion and at the option of KAPOWUI.
5) Permission to Obtain Medical Assistance: In the event of any injury, illness, emergency, accident or other harm sustained by me (or by the minor on whose behalf I am signing this document), I hereby give KAPOWUI permission to obtain Medical Assistance, in which event I hereby make the same releases and waivers in KAPOWUI™s favor as I have otherwise made in this agreement in connection with any such medical assistance sought or not sought. In addition, the expenses for any such medical emergency shall be my sole responsibility and not that of KAPOWUI.
6) I HAVE READ THIS DOCUMENT IN ITS ENTIRETY AND IT IS MY INTENTION THAT IT BE BROADLY CONSTRUED IN FAVOR OF KAPOWUI IN THE EVENT OF ANY AMBIGUITIES, WHICH SHALL BE RESOLVED IN KAPOWUI™S FAVOR. I UNDERSTAND THAT I AM ASSUMING ALL THE RISKS INHERENT IN THIS SURFING ACTIVITY, AND THAT I MAY BE INJURED, BECOME ILL, OR EVEN DIE AS A RESULT OF SURFING. I UNDERSTAND THAT THIS IS A RELEASE OF ANY AND ALL CLAIMS. I UNDERSTAND THAT THIS IS THE ENTIRE AGREEMENT BETWEEN ME AND KAPOWUI, AND THAT NO REPRESENTATIONS HAVE BEEN MADE TO ME BY KAPOWUI OUTSIDE OF THIS AGREEMENT. I VOLUNTARILY SIGN MY NAME AS EVIDENCE OF MY ACCEPTANCE OF ALL THE PROVISIONS IN THIS RELEASE AND MY AGREEMENT TO BE BOUND BY THEM.

COVID-19 RULES AND POLICIES

Instructors will be trained on OSHA, CDC, and WHO standard and directives and will be expected to adhere to all guidelines.

Any instructor who is known to have Covid or exhibits signs of Covid (coughing, fever, shortness of breath, head ache, etc..) will be requested to go home and will not be allowed to return to work until they have been tested and cleared by health care professional.

Lessons will be staggered to keep all clients and instructors from coming in contact with one another.

Instructors must maintain 6’ social distance while at work.
-
Instructors will wear gloves, glasses, and face mask during all lessons and at all times while at work.

All lessons will pay online for their lesson prior to lesson or use tap feature on Apple Pay.
-
All liability waivers will be completed online.
-
Greeting and valedictions with lessons will not include any physical contact.

All lessons temperature will be taken prior to lesson and any lessons that show symptoms of Covd-19 will not be allowed to proceed with lesson and will be fully refunded.

Only one instructor/ assistant will be allowed in the van per day to retrieve needed equipment or supplies for lessons.

Clients will be required to wear face mask from the moment of greeting till they leave work area. If they do not have a face mask, we will provide them with one.

Wetsuits for clients will be put in a designated place for them to retrieve and don.

Disinfectant gel and wipes will be available for all lessons and they will be requested to use them before the lesson begins.

Clients will not be allowed to leave any personal items with the instructor/ in the vans.

Surf instructor will preset boards on the beach in the morning and they will be left there all day, all boards will be disinfected at the beginning of each day, between each lesson and at the end of each day.

Van will be wiped down with disinfectant every hour.

Instructors will be required to disinfect hands between each client

Board will be left at the beach between lessons so the UV light and heat will help disinfect the boards.

Instructors will keep appropriate social distance from the lesson at all times, as suggest by CDC.
Kapowui Procedures, policies, and guidelines for COVID social distancing while at the workplace and while giving surf lessons. These procedures will be reassessed daily and updated as needed. The policies will be posted on website and at the van for Clients to know what is expected of them and what they can expect from us to stay safe during their surf lesson.

All wetsuits will be soaked for 10 minutes in a bucket containing disinfectant and left in the sun and heat to dry after each lesson
I’m currently having 1000 face masks made and will be available for all clients who need one during their lesson.
Additional Safety Precautions
If you or your children feel ill at anytime, please notify a staff member and the necessary next steps will be taken. For everyone else, please:

ARRIVAL AND DEPARTURE FOR FAMILIES:
All campers and visitors must wear cloth face coverings at arrival and departure.
All individuals must minimize contact between camp staff, campers and families at the beginning and end of the day.
Where feasible we will provide physical guides, such as tape on floors or sidewalks and signs on walls, to ensure that camp staff and campers remain at least 6 feet apart in lines and at other times.
SCREENING CAMPERS
Staff and Campers and their families must stay home when they have symptoms
Staff and campers who are sick or who have recently had close contact with a person with COVID-19 must stay home and immediately report to Martin (310-985-4577
All campers will be screened upon arrival for symptoms including Fever, Cough, Shortness of breath or difficulty breathing, Chills, Repeated shaking with chills, Muscle pain, Headache, Sore throat, New loss of taste or smell. The screening will include a no-touch thermometer temperature check.
All individuals will be asked about COVID-19 symptoms within the last 24 hours and whether anyone in their home has had COVID-19 symptoms or a positive test.
Any child, parent, caregiver, or staff showing symptoms of COVID-19 will be unable to attend camp.
Staff and campers will be monitored throughout the day for signs of illness; campers and staff will be sent home with a fever of 100.4 degrees or higher, cough, or other COVID-19 symptoms. Persons will be sent to the appropriate medical facility rather than their home if necessary.
MEASURES FOR INFECTION CONTROL:
Campers will remain in the same space and in groups as small and consistent as practicable. The same campers and staff will stay with each group and include campers from the same family in the same group, to the greatest extent practicable.
All visitors and campers are required to wear cloth face coverings while at camp, except while swimming, eating/drinking, or engaging in solo physical exertion (such as jogging by one’s self).
On the beach children will sit no less than 6 feet apart and in a way that minimizes face-to-face contact.
Adequate supplies will be available to support healthy hygiene behaviors, including tissues and hand sanitizers with at least 60 percent ethyl alcohol for staff and those campers who can safely use hand sanitizer.
Campers will be taught the following personal protective measures:

Sanitizing hands regularly before and after eating; after coughing or sneezing; after being outside; and after using the restroom.

Avoid touching your eyes, nose, and mouth
-
Cover coughs and sneezes
-
Use a tissue to wipe your nose and cough/sneeze inside a tissue or your elbow.
Campers and staff will use hand sanitizer when handwashing is not practicable. Sanitizer must be rubbed into hands until completely dry.
Frequently touched surfaces such as surfboards, canopies, tables, flags and rescue can as well as surfaces in transportation vehicles will be cleaned at least daily and more frequently throughout the day.
There will be no sharing of objects and equipment, such as boogie boards and surfboards unless cleaned and disinfected between uses.
Camper’s will keep their backpacks separated and may touch only their own belongings, including water bottles and towels. Belongings must be taken home each
day to be cleaned and disinfected. Only bring what is absolutely necessary, no extra toys, books, electronics, etc.
Wetsuits require an effective cleaning procedure and “down time” of at least three days between uses to minimize risk of COVID-19 transmission, therefore campers will keep their wetsuits for the week.
Cleaning products are those approved for use against COVID-19 on the Environmental Protection Agency (EPA)-approved list “N”. These products contain ingredients which are safer for individuals with asthma.
Instructors will be responsible for responding to COVID-19 concerns. They will coordinate the documentation and tracking of possible exposure, in order to notify local health officials, staff, and families in a prompt and responsible manner. Confidentiality is ensured.
EMPLOYEES SAFETY MEASURES
All employees have been told not to come to work if sick, or if they are exposed to a person who has COVID-19. Employees understand to follow DPH guidance for self-isolation and quarantine, if applicable.
Case(s) must isolate themselves at home and immediately self-quarantine including all employees that had workplace exposure to the case(s).
All quarantined employees have access to be tested for COVID-19.
Symptom checks are conducted upon arrival for all employees including a temperature check.
All employees are required to wear face coverings at all times during the workday when in contact or likely to come into contact with others.
Employees are instructed to wash their face coverings daily.
Employees are also offered gloves for tasks that require them to handle frequently touched surfaces.
Employees have been instructed to maintain at least a six feet distance from others in all areas of camp. Employees may momentarily come closer as necessary to assist children, or as otherwise necessary.
Areas are disinfected frequently: van, table, surf and boogie boards, flags, and canopy.
Disinfectant and related supplies are available to employees at the following location(s): Van, table, and canopy
Hand sanitizer effective against COVID-19 is available to all employees at the following location(s): van, table, canopy.
As much as feasible each worker has instructed to avoid sharing work supplies, wherever possible. They have also been instructed to never share PPE.
Where items must be shared, they are disinfected with a cleaner appropriate for the surface between shifts or uses.
A copy of this protocol has been distributed to each employee.
IF STAFF OR CAMPERS BECOMES ILL
A person will be isolated from the group who exhibits symptoms of COVID-19 until they can be transported home or to a healthcare facility, as soon as practicable. (Fever, Cough, Shortness of breath or difficulty breathing, Chills, Repeated shaking with chills, Muscle pain, Headache, Sore throat, New loss of taste or smell)
They will wear a cloth face covering or surgical mask if they do not have issues breathing with the mask on.
Parents or guardians will pick-up anyone sick as soon as possible. A call to 9-1-1 will be made immediately if the individual develops persistent pain or pressure in the chest, confusion, or bluish lips or face.
Sick staff members and campers may not return until they have met CDC criteria to discontinue home isolation, including 3 days with no fever, symptoms have improved, and 10 days since symptoms first appeared.

In consultation with the local public health department, the camp may consider closure if warranted for a length of time, based on the risk level to the community.
COMMUNICATION TO THE PUBLIC
Staff and families should self-report symptoms and receive prompt notifications of exposures and closures while maintaining confidentiality.
Copies of this protocol document will be on display at camp.
Signs will be displayed to remind people: physical distancing, face coverings usage at every opportunity, stay home if sick with respiratory symptoms.
Staff will direct guests in high traffic areas and times.

We will be conducting both symptom and temperature checks for all employees and campers daily upon arrival.
Employees and campers will wear face masks at all times except when in the water or eating and drinking.
Children will not eat lunch at the camp.
We will not play ball games such as dodgeball or touch games such as sharks and minnows.
Employees usually assist campers with wet suits daily. This year campers will be asked to arrive in their wet suits, take them home, and keep the same wet suit for the entire week. After the week wetsuits can be
appropriately and thoroughly cleaned.
We do not have restrooms to clean but will have multiple hand-sanitizing stations.
Equipment will be cleaned after each use and incidence of contact. Including the van, the table, surf and boogie boards, canopy and flags whenever touched.
Disinfectant and related supplies including hand sanitizer effective against COVID-19 are available to employees at the following location(s): The van, the table, the canopy.
We have split our session into two small groups, morning and afternoon, instead of one full day session with more children.
Children are required to attend the whole week instead of picking and choosing days throughout the summer so that we can restrict potential exposure.
Our number of campers will be limited to 15 in a group or session.
Campers will be asked to wait in their cars with their guardians until we call them when it is time to go down to the beach so that we avoid a group congregating.
During session greeting and breaks children will sit 6 feet apart on the beach.
Campers will be taught personal protective measures at the beginning of each session.
Each child will use their own assigned boogie boards for the day after which it will be disinfected. Surfboards will be cleaned and disinfected between uses.
Camper’s are asked to bring only necessary items such as towels, water and sunscreen to camp. Their backpacks will be spaced no less than 6 feet apart.
